In these terms and conditions, the following definitions apply:
HoKi-media: Marinka Noordhout, trading under the name HoKi-media, established at Petőfi Utca 38, 7535 Lad, Hungary;
App: the Hungarian grammar app offered by HoKi-media;
User: any natural person who uses the App;
Subscription: an agreement between HoKi-media and the User for the use of the App.
These terms and conditions apply to all offers, agreements and deliveries of services by HoKi-media.
Deviations from these terms are only valid if explicitly agreed upon in writing.
HoKi-media offers the following subscriptions:
Basic subscription: €36,00 per year
Premium subscription: €48,00 per year
All prices stated are inclusive of VAT, unless otherwise indicated.
HoKi-media reserves the right to adjust prices. Price changes will be announced at least 30 days in advance.
In the event of a price increase, the User has the right to cancel the subscription within 30 days of the announcement.
The agreement is formed at the moment the User takes out a subscription via the App and payment has been completed.
After taking out the subscription, the User will receive a confirmation by email.
The subscription has a duration of one year and is not automatically renewed.
Prior to the expiration of the subscription period, the User will receive an email from HoKi-media with the option to renew the subscription and choose the desired subscription type (Basic or Premium).
If the User does not respond to this email or does not make a payment, the subscription will expire at the end of the current subscription period. After expiration, the User's data will be retained for one month, giving the User the opportunity to reactivate the subscription.
Payment of the subscription must be made in advance. There is no automatic renewal or automatic direct debit.
If the User does not respond to the renewal email or does not make a payment, the subscription will expire at the end of the current subscription period.
In the event of late payment, HoKi-media reserves the right to suspend access to the App.
If the User indicates within 3 days of payment that they are not satisfied, the User is entitled to a refund of the amount paid. The refund period is 5 to 10 days, depending on the processing time of the payment provider. HoKi-media has no influence on this.
The User agrees to:
All intellectual property rights relating to the App are vested in HoKi-media.
The User is not permitted to copy, modify or distribute the App or any part thereof without the prior written consent of HoKi-media.
HoKi-media is not liable for damages arising from the use of the App, unless there is intent or gross negligence.
HoKi-media is not liable for indirect damages, including consequential damages, loss of profit and missed savings.
HoKi-media is not liable for damages resulting from incorrect or incomplete information provided by the User.
HoKi-media strives to keep the App available as much as possible, but cannot guarantee uninterrupted availability.
HoKi-media reserves the right to temporarily take the App offline for maintenance, updates, or other technical work. Where possible, HoKi-media will communicate this in advance.
In the event of prolonged unavailability due to circumstances within HoKi-media's control, the User has the right to request a proportional refund.
HoKi-media is not liable for damages resulting from unavailability caused by circumstances beyond its control, such as hosting provider failures, force majeure, or external attacks.
HoKi-media reserves the right to modify the App and these terms and conditions.
Changes will be announced via the App or by email.
If the User objects to changes, they have the right to cancel the subscription.
HoKi-media processes personal data of Users in accordance with the privacy policy.
The User consents to the processing of his/her personal data as described in the privacy policy.
Hungarian law applies to these terms and conditions and all agreements between HoKi-media and the User.
All disputes will be submitted to the competent court in Hungary.
If any provision of these terms and conditions is void or annulled, the remaining provisions remain fully in force.
In cases not provided for in these terms and conditions, HoKi-media will decide.
